Claude Le Brun de la Rochette - Le Proces Civil et Criminel - 1658

DESCRIPTION: I present at auction an exceptional 17th-century treatise on forensic jurisprudence and criminal practice: "Le Proces Civil et Criminel", written by the illustrious jurist Claude Le Brun, de la Rochette, lawyer in the seneschalty and presidential chair of Lyon. Printed in Lyon in 1658 in the workshops of André Ollier (rue Tupin, à la Licorne Gerbée), this volume is the definitive, corrected, and considerably expanded edition by the author. It is famous for containing one of the most explicit, raw, and fascinating analyses of penal and moral casuistry of the Old Regime. CATASTROPHES MORALES, SODOMY, INCEST, AND FORNICATIOn: THE DARKEST PENAL CASELAW This revised and expanded edition stands out for delving into the typification and forensic instruction of the era’s darkest and most severely punished crimes: + "La Faineantise, Source de Tous Crimes Malheureux" (Idleness as the Seedbed of Evil): Philosophical-legal analysis that deems laziness the primordial origin of perversion and crime. + "La Fornication" (Systematic Classification of Illicit Sex): A detailed anatomical-forensic scheme that classifies forbidden unions: from seduction and kidnapping of virgins, nuns, married and widowed women, to adultery and prostitution. + "L'Inceste" (Incest and Its Capital Punishments): Study of relationships forbidden by consanguinity and affinity (mothers, daughters, sisters, aunts, nieces), analyzing the death penalty and public ignominy. + "La Sodomie, Est Peche Contre Nature" (Crimes Against Nature): Explicit reference to the persecution of sodomy and bestiality (avec la beste brute), recalling the divine punishment of Sodom and Gomorrah and its severe punishment in the royal courts. + Judges of Blood, Murders and Robberies: Royal summaries on brigandage, treacherous assaults, nighttime robberies with weapons in private chambers, and conspiracies of servants against their masters. ORNAMENTAL PROGRAM AND EDITORIAL STRUCTURE: + Baroque Two-Color Typographic Cover (Red and Black): Dominated by a monumental woodcut shield of the French Monarchy decorated with fleurs-de-lis, the royal crown, and the collars of the orders of chivalry. + Includes treatises for judging by special courts: Military Courts and Marshals; and Financial and Fiscal Justice. + Historiated Typography and Initials: Rich woodcut headers with florals, baroque friezes, and large-format historiated initials.
