The expression describes the obligation for an act or performance by a third party "alium daturum facturumve" – that a third party will give or do something. According to classical Roman law (e.g., Gaius’ Institutes or Justinian, Inst. 3,19,3), a promise is invalid if one promises that another will do or give something (e.g., “I vow that Titius will pay five pieces of gold.” What is valid, however, is the promise to vouch for the result that the third party will perform (e.g., “I will ensure that Titius pays”).
